Philip H. de Leon, International Trade Specialist, BISNIS, U.S. Department of Commerce (DoC)
BISNIS (Business Information Service for the Newly Independent States) is the U.S. Government`s one-stop shop for doing business in Russia and the other states of the former Soviet Union. Their Search for Partners Program helps match NIS firms with potential partners in the U.S. Mr. de Leon will be specifically addressing the "Tricks of the Trade" in attracting Export financing for NIS transactions. In 1998, BISNIS created the BISNIS FinanceLink to assist in finding financing. U.S. companies are encouraged to use their free service by completing a form. The form is forwarded to participating financial service providers that are incorporated and active in the U.S. and have expressed an interest in doing business in the NIS.

Sandy Vora, Legal Counsel-Workplace Issues, Office of General Counsil, U.S. DoC
Sandra Vora is a lawyer with the Office of the General Council specializing in Workplace Issues. She is responsible for defending the U.S. Department of Commerce in cases including but not limited to sexual harassment. Ms. Vora will make a presentation to the delegation about the liability of the Department of Commerce concerning the conduct of its employees both during and off-work hours. All DoC employees must attend this briefing. As participants of a U.S. Department of Commerce program, all SABIT delegations are given the same briefing as DoC employees and are held to the same standards of conduct.

Michael E. Hale, President, Hale & Associates LLC
Michael Hale has been an integral component to the SABIT training team for several years. First presented to SABIT's Defense Conversion Program in 1995, Michael Hale's business culture program has prepared hundreds of SABIT interns for successful business meetings and negotiations with U.S. partners. The program is designed to give program participants a better understanding of the cultural differences between potential U.S. and NIS partners and their operational frames of reference.

The Business Information Service for the Newly Independent States (BISNIS) is the U.S. Government's one-stop shop for doing business in Russia and the other states of the former Soviet Union. Their Search for Partners Program helps match NIS firms with potential partners in the U.S. Mr. Nowek will travel with the delegation to the site visit with Apple Computer and the STARWEST Conference in San Jose, CA. He will assist the group in meeting with vendors at the show that may be interested in doing business.

Judith Currie, Exports Controls Specialist, Bureau of Export Administration, U.S. DoC
Export controls on commercial encryption products are administered by the Bureau of Export Administration (BXA) in the U.S. Department of Commerce. Rules governing exports of encryption are found in the Export Administration Regulations (EAR), 15 C.F.R. Parts 730-774. Sections 740.13, 740.17 and 742.15 are the principal references for the export of encryption items. In most cases, your encryption item will be eligible for export under a license exception, so you should carefully review the encryption policy in Part 740 and 742.15 of the Export Administration Regulations (EAR) before you submit a license application. If your product and/or end-user do not qualify for a license exception or an encryption licensing arrangement, you must request an individual export license for your transaction. These license applications are reviewed on a case-by-case basis. This guidance is designed to help you in applying to export certain encryption items not eligible for a license exception or encryption licensing arrangement and should only be used in conjunction with the relevant portions of the Export Administration Regulations (EAR). Examples are encryption exports that require a license are exports of technology (ECCN 5E002), products that contain an open cryptographic interface, or "non-retail" products to government end-users located outside the countries listed in Supplement 3 to Part 740. Also, all exports of encryption items to the terrorist-supporting and embargoed countries require an export license.

For over 200 years, the basic role of the Patent and Trademark Office (PTO) has remained the same: to promote the progress of science and the useful arts by securing for limited times to inventors the exclusive right to their respective discoveries (Article 1, Section 8 of the United States Constitution). Under this system of protection, American industry has flourished. New products have been invented, new uses for old ones discovered, and employment opportunities created for millions of Americans. The PTO is a non-commercial federal entity and one of 14 bureaus in the Department of Commerce (DOC). The office occupies a combined total of over 1,400,000 square feet, in numerous buildings in Arlington, Virginia. The office employs over 5,000 full time equivalent (FTE) staff to support its major functions – the examination and issuance of patents and the examination and registration of trademarks.

Jay P. Kesan, Assistant Professor, College of Law, University of Illinois at Urbana-Champaign
Professor Jay Kesan received his J.D. summa cum laude from Georgetown University, where he received several awards and served as associate editor of the Georgetown Law Journal. He clerked for Judge Patrick E. Higginbotham of the U.S. Court of Appeals for the Fifth Circuit. Professor Kesan is a registered patent attorney and practiced at the law firm of Pennie & Edmonds LLP in the areas of patent litigation and patent prosecution. He also has a Ph.D. in electrical and computer engineering from the University of Texas at Austin. Prior to attending law school, Professor Kesan worked as a research scientist at the IBM T.J. Watson Research Center in Yorktown Heights, New York and published numerous scientific papers and obtained several patents world-wide. Professor Kesan teaches and writes in the areas of intellectual property, law and regulation of cyberspace, and science, technology and the law. Professor Kesan teaches Patent Law, Law and Regulation of Cyberspace and Theoretical Foundations of Intellectual Property. At the University, he holds positions in the College of Law, the Department of Electrical and Computer Engineering and the Institute of Government and Public Affairs.

Sergei Shkurkin, Principal and CEO, Sergei Shkurkin and Associates
